I filed a dispute claim with PayPal on July 19, 2017, regarding a counterfeit Chanel Handbag I purchased on EBay on May 21, 2017. PayPal prematurely denied my initial dispute claim on July 24, 2017; in five days without due process on behalf of the buyer.
I was not given the opportunity to provide PayPal any documentation when they rendered their decision to deny my claim. There decision was made based on the fact that the Merchant had won the case with Ebay because I filed a dispute outside the 30 EBay purchase protection period. PayPay claims to have 180 purchase protection. On October 7, 2017, PayPal denied my subsequent appeal without any giving any evidence to me from the Merchant that the bag is authentic.
Upon denial of my appeal, PayPal stated, "we have found no evidence that the item was misrepresented. If you would like a copy of the documentation we used in the investigation of your claim, send a letter to Attn: Billing Error Dispute Documentation Request, P.O. Box 45950, Omaha, NE 68145." To date I have mailed the request via USPS, tracking number: 9505510703537284176826; emailed the request to the provided email, ICA-NA@PayPal.com twice; then called several times with hold time up to 2 hours to request the documentation (screenshots available), however, PayPal remains unresponsive. I initially contacted PayPal on July 19, 2017, to file a case against the merchant whom listed the bag as 100% authentic in her listing on Ebay.
The Merchant offered a authentic guarantee in the EBay listing; however, upon notifying the merchant that I had the bag authenticated and it was determined NOT authentic and therefore significantly not as described. The Merchant declined my request to return the bag and made no offer of proof to certify that the bag is authentic. My decision to purchase this bag was based on the Merchant’s Ebay listing’s authenticity and guarantee claims that the item, the Chanel Maxi Flap Handbag, but this clearly was not the case nor supported by any documentation (e.g., receipt of purchase for Chanel or an equivalent). The bag's stitching began unraveling after 3-4 uses.
This raised a red flag for me. Consequently, I submitted the bag to an independently recognized Chanel expert for authentication. As indicated in the documentation provided to PayPal from a PayPal and EBay recognized Chanel Authenticator, the bag I purchased on Ebay was determined to be a counterfeit.
Therefore, I requested to return the bag to the Merchant for a full refund of the purchase and shipping of the counterfeit bag. PayPal remains unresponsive to date and did not require proof of authenticity from the EBay merchant.
